John Hergt's major asset is that he leaves nothing to chance. He is meticulous and creative. For example his pre-trial research in one case revealed that a federal judge who had been on the bench for many years applied outdated procedural rules - rules applicable in the 1950's and before. John "accommodated" the environment by trying the case following 1950 style procedures and won.

In another case his client had been terminated after 25 years and had visited numerous attorneys to obtain representation. He was told that he had no case. In desperation, his wife conducted an Internet search and contacted John. He took the case, and using a statute unrelated to employment sued the employer. Legal commentators in newspaper articles claimed that John did not have a case. He wrote one of them and explained why he would win. After the employer's efforts to dismiss the case before a conservative court failed, the employer quickly settled.
